Description
The main purpose of this paper is to contribute to the development of the transfer of evidence from interception measures between Germany and Brazil. In order to determine whether a transfer of evidence is feasible, the most important legal issues concerning the interception of telecommunications are highlighted and the particularities of the German and Brazilian legal systems are elaborated. For this purpose, it was necessary to examine the laws, doctrine and case law for both countries and to identify similarities and differences. As a result, this study not only fulfills academic purposes, but also prepares the material specifically for forensic practice.
