Beschaffung als Anwendungsvoraussetzung des deutschen und europäischen Vergaberechts

German and European public procurement law has gained increasing attention in German law and practice over the past 30 years and has become a recognised area of public commercial law. Nevertheless, a fundamental question of public procurement law has so far been almost completely unprocessed, namely the question of how to define public procurement. On the other hand, there are disagreements as to the extent to which a public procurement is a fundamental requirement for the application of public procurement law. With her work, the author closes this legal gap.
