The work develops a transparent regulatory concept for the implementation of big data analyzes (also “people analytics”) in human resources. Based on abstract data protection law, specific application examples are used to develop solutions that enable the interests of employers, employees and the works council to be balanced in a practical manner. This is achieved through the technical and organizational separation of data analysis and presentation of results ("informational separation of powers"), to which the actors are obliged by virtue of the company agreement. In addition, the work examines special features of employee participation in the algorithmic processing of employee data.
