Description
The outer appearance of civil servants raises new problem areas through the recent process avalanche - in which mostly young applicants for the police officer service were rejected because of their tattooing. A detailed analysis of the relationship between Article 33 (2) GG, duties of public servants and Article 2 (1) GG is necessary in order to develop a suitable scheme which is caused by intricate and partly incomprehensible court decissions. In addition, that multi-part ratio is further strengthened by the factor of social acceptance and the resulting need for interpretation, and also has an effect on the relationship between the official assessment prerogative and judicial control. Finally, a categorization of the tattoo is developed which refers to that scheme under influence of its legal character.
