In Germany, cartel law violations are predominantly sanctioned as misdemeanors. As a result, antitrust violations are sanctioned at the national level in the context of a fine procedure, as governed by the provisions of criminal procedure law (OWiG, StPO). The application of criminal procedure law is linked to the validity of criminal procedure maxims and the involvement of the public prosecutor. The purpose of this thesis is to examine the question of the extent to which German cartel fine proceedings should be reformed and how procedural delays can be prevented while simultaneously promoting truth. This raises the question of whether a reformed cartel fine procedure can serve as a model for modern economic criminal procedures.
