It is necessary for the proper functioning of the internal market to determine the law applicable to the effects of insolvency proceedings on transactions with legal certainty. Based on a europe-wide uniform qualification method the work explores the law applicable to insolvency avoidance in accordance with Art. 7 II lit. m), 16 of the European Insolvency Regulation.
