In its initial question, this book addresses the possibility of a comprehensive right of rescission. It focuses on methodological justification, without ignoring the fundamental and justified criticism of the notion of copyright protection. Therefore, the book develops a deductive method and refers to the idea of a cultural law as a condition of law, which points out an individualistic principle. The book accompanies this principle with the method of functionality, with which rights and legal positions can be understood in terms of content, and tries to answer the initial question by determining the function of copyright. In its second part, the book turns to the practical questions which would arise if a comprehensive right of rescission was incorporated into German copyright law, and shows how such a right could be embedded into the existing legal situation.
