Studies in International Law of the Sea and Maritime Law – Internationales Seerecht und Seehandelsrecht
Details
In this study, the international law of naval blockade is presented. According to recent practice, the inquiry differs between the legal regimes of naval blockade in a context of international armed conflict and one in a non-international armed conflict. The reader learns the contemporary rules a State has to obey if it implements and enforces a naval blockade. In particluar, the neutral States’ impairments of their maritime and commercial freedoms are taken into account. Nevertheless, no State enjoys a right according to which neutral States have to follow the naval blockade. Rather, the legal relationships of the parties concerned are characterised by non-prohibited acts of international law.
