Description
Testators suffering from dementia are a common phenomenon in times of a society that keeps growing older - not only in Germany, but world-wide. This book analyses the relationship between dementia and the capacity to testate, also taking into consideration practical issues that arise in this field. Furthermore, solutions de lege ferenda are presented with regard to the problem of testators who are still capable to draft a will but are prone to undue in-fluence, and of testators who have lost the capactiy to testate. To this end, the American doctrine of undue influence and the Australian statory will-proceedings are incorporated into the broader picture.
