During the course of an empirical investigation, it was found that the ethical concept of the German Animal Welfare Act does not conform to people’s sense of morality and justice. The author of this study shows how a subtle error in logic managed to creep into the aforementioned act of 1972, and investigates this serious error from the viewpoints of politics, philosophy and jurisprudence. In doing so, he explains a proposal for an ethically correct version of the principle of proportionality that is applicable to non-human fields by means of numerous examples. This new view on the principle of proportionality might have an impact on the legal understanding of the protection of animals, environmental protection and nature conservation.
