§ 58 Abs. 1 UrhG (German Act on Copyright) is a statutory exception from German Copyright Law that deals with the entitlement of museums, auction houses, and galleries to copy an artistic work in order to advertise its exhibition or its sale without license and royalty-free. However, the interpretation of the provision’s wording is controversial. It is not clear to what extent the respective institutions are entitled to advertise. The book examines § 58 UrhG and compares it to the corresponding provisions from British and US-American Copyright Law. Furthermore, the practice of the German collecting society Verwertungsgesellschaft Bild-Kunst as well as the practice of the respective collecting societies in the United Kingdom and the USA is set out.
