Die Abwicklung von Banken nach Art. 18 SRM-VO

Following the 2008/2009 financial crisis, the EU legislature transferred responsibility for crisis management of large, systemically important eurozone banks to a new EU authority, the Single Resolution Board (SRB). The SRB applies a new and so far hardly tested administrative procedure. The author examines the suitability of this procedure, in particular the prerequisites for initiating the procedure, decision-making and implementing the resolution decision, presents the pitfalls of the complex procedure for bank resolutions and identifies possible solutions. Economic findings on banking crises as well as EU primary law serve as the main assessment yardsticks.
