This publication focuses on the legal aspects of medicinal plants, which may have an increasing importance for us. In addition to deriving a legal definition of medicinal plants, the existing legal provisions that play a role in the field of medicinal plants are analyzed, taking into account the constant development in plant breeding and genetic technology. Furthermore, the specifics related to the industrial property protection of medicinal plants are highlighted, and the international and EU regulations on biodiversity, in particular the protection of the medicinal plant as traditional knowledge and the associated duties of care, are analyzed.
