Die Berufsrechtssubjektivität von anwaltlichen Berufsausübungsgesellschaften

Today, the majority of lawyers practise their profession in professional practice companies. The comprehensive reorganization of the law of professional practice companies for lawyers as of 1 August 2022 follows this development by no longer exclusively addressing the individual lawyer, but also the company in which he practices his profession. The subject of this thesis is to analyse the structure of this so-called entity-based regulation under the Federal Lawyers’ Act (BRAO). Its focus is on ensuring compliance with professional law within the professional practice company, specifically highlighting what constitutes a compliance management system as a central element of suitable measures under § 59e paragraph 2 sentence 1 BRAO.
