Simple, unsecured electronic documents generally do not provide a guarantee for their authorship and authenticity, as they can be altered without a trace. With respect to certificates, the situation is different: The order of the text, the external properties of the carrier material and the signature are strong indications for their authenticity and integrity. In order to avoid a loss of evidence in contrast with conventional paper certificates in the increasingly electronic world, there are various security instruments, such as the qualified signature as an encryption method or De-Mail as a transport medium. The evidential value of these secured electronic documents is investigated in this work. The existing regulations in civil procedure, especially in the law of personal inspections, and the European eIDAS regulation are analysed.
