This work deals with the question of how human rights violations can be remedied by the member states of the ECHR in the course of criminal proceedings. By systematising and evaluating the required measures (e.g. exclusion of evidence, mitigation of punishments, review by an appeal court or the sole or decisive rule), it provides a comprehensive overview of the relevant jurisdiction of the ECtHR. Thus, it not only answers the question whether the required measures in fact provide a sufficient redress for the accused, but also examines how the required measures can be applied within German criminal procedure. Finally, the author comes to the conclusion that the practice of the ECtHR to examine if the proceedings as a whole have been fair or not is to be strongly criticised.
