In the democratic system of the Federal Republic of Germany and its federal states, governmental action is not only controlled by independent courts, but also and especially by the parliamentary bodies. Since government and parliamentary majority are closely connected in the party democracy, the parliamentary opposition in particular plays an important role in effectively controlling the executive branch. Classical Instruments of this control are the right to question and information of the delegates, as well as the right to instate a committee of inquiry. As a rule, the constitutional courts determine the scope and limits of these rights. This contribution provides insight into the jurisdiction of the Bavarian constitutional court on relevant proceedings by means of several examples.
