Under current law, a company can acquire a perpetual nature by transferring its shares to a foundation. However, the consequence of such a foundation solution is that the company receives a very inflexible shareholder in the form of the foundation, in particular because it is subject to state supervision. The entrepreneurial desire for perpetuity with constant flexibility can therefore hardly be fulfilled. This book takes this circumstance as an opportunity to discuss the necessity of a special law for the company-affiliated foundation. At the same time, concrete regulatory proposals for a special right are put forward, thus laying a possible basis for such special right.
