Die Verkehrsfähigkeit und Bestandssicherheit urheberrechtlicher Lizenzen

This work evaluates whether the current legal framework governing the licensing of creative content does justice to the increased economic and social relevance of the licensing of cultural goods with regard to the continuance and marketability of copyright licences. In addition to conducting a dogmatic examination of the relevant legal regulatory areas, the study advocates a practical balance of the interests of all parties involved in the licensing chain, taking into account economic value creation. Following a fundamental introduction to this subject’s methodological and legal-economic foundations, the author examines the degree of continuance and marketability vested in copyright licences in the regulatory areas of insolvency, succession protection and transferability.
