How can, should and may the use of temporary agency work be regulated by German legislators? This study examines which requirements the European Directive on Temporary Agency Work imposes, especially by using the term ‘temporary’. Nevertheless, the author also discusses the legal requirements imposed by German Constitutional Law and the European Treaties. Furthermore, the study turns towards the regulation of temporary agency work in Germany and determines whether or not it meets the European Legislators’ provisions. Finally, the author illustrates the consequences of insufficient implementation of European law into German national law.
