The upshot of intensive European Parliament debate about the effects of nation state and European reform projects has been Council Directive 96/92 on Common Measures for the Single Market in Electricity - a firm foundation! Union energy ministers" agreement on this Directive and the passing of Germany"s Federal Bill amending legislation governing the energy industry, hallmarked the proceedings of Cologne University"s 25th Expert Session on Energy Law run by the University"s "Institute for Energy Law".
Experts from politics, science and practice chewed upon the Federal Government bill to decide what is to happen to energy supply contracts and, in the absence of the sole rights agreements, to local government "Land" energy suppliers. Also dealt with were price formation in a competitive climate and the Treaty"s "services publics" in Article 90 Paragraph 2. Are they public utilities?
