For the first time the Treaty of Lisbon expressly introduced legislative powers at EU level in the domain of criminal law in Art. 83 TFEU. Before, these competencies had been heavily disputed because criminal law had been excluded from previously applicable treaties.
The book contains a comprehensive presentation of the legal situation of the European Union's competencies in criminal law in the light of the case-law of the ECJ and after the Treaty of Lisbon came into force. The actual changes brought about by this new situation are highlighted. For this purpose the prerequisites and the scope of the current competency will be expressly pinpointed. Finally possible conflicts with the principle of democracy prevailing at EU level and appropriate approaches for solutions are described.
On the one hand the reader gets a comprehensive understanding of the problem and on the other hand he is presented with an in-depth examination of the topic.
