Due to medical advances, the liberalisation of social norms and progressing international ties, new family models have become more and more common. Therefore, there is a growing need for the law to also reflect these new family models. This book examines the differences between French and German family law in answering old and new questions regarding the regulation of family ties in law. The book concludes that, while the two legal systems do not have a diverging hierarchy in terms of the criteria ‘bloodline’ and ‘voluntary parenthood’, the legal regulations in the two countries reveal fundamental differences in the social conceptions of parenthood, family and the best interests of a child.
