This study offers a new perspective on the German law on staff representation and will further the reader’s understanding of co-determination in the public service. It conveys ideas on how to apply and interpret the Bundespersonalvertretungsgesetz (BPersVG), the law which forms the legal foundations of the training and duties of public service representatives of employees, young people and apprentices, and conducts a dual focus analysis of this law which is the first of its kind to link its legal and social function with an approach based on legal theory. In doing so, it first examines the BPersVG’s social and standard structural functions in order to portray the configuration of the law’s legal norms and reveal the relationships which derive from it. In this respect, the study particularly addresses the fact that the BPersVG represents and balances social interests, regulates and resolves conflicts, devolves power and concretises structural norms, and guarantees certain tasks and provides a framework for conducting staff representation, each of which is based on individual and specially designed legal norms, in particular the way in which the section on trust is worded in the clause on cooperation. This book will appeal above all to jurists, researchers and lecturers at universities and public administration colleges, students of law and public administration, administrative courts and industrial tribunals, administrative authorities, heads of service, staff councils, employees, associations, trades unions and libraries. The author is the former head of the Institute of Public Administration and Finance at the University of Applied Sciences in Ludwigsburg, where he still works part-time. He has also written countless publications for journals which focus on the law on staff and civil servant representation.
