Even mergers between hospitals that are required in terms of health policy have to overcome obstacles under antitrust law. The hospital financing and planning law described by the author regulates the competition parameters price, quantity and quality. The formal and material requirements of merger control are critically examined, in particular the factual and geographic market definition of the Federal Cartel Office. The appendix contains the legislative development of the hospital sector up to 2020. The author works as a lawyer at the interface between hospital and antitrust law for over 10 years. An added value of this scientific work lies in the practice-oriented approach.
