This book presents and examines potential approaches to legal protection in cases of human rights violations by transnational corporations. Covering a range of legal fields, it offers extensive insights and support for human rights lawyers and aims to provide an impetus for further academic and practice-oriented research.
The study addresses the question of corporate liability under international law and examines the existence of extraterritorial home country duties with regard to human rights protection. It moreover considers matters of procedural law, conflict of laws and material civil law. In this respect, it focuses on the role of human rights codes of conduct in determining the relevant duty of care of corporations under the law of torts. An assessment of state liability law, criminal law and unfair competition law as well as reflections on suitable reform proposals complete the study.
