Intertemporales Strafrecht am Beispiel behördlicher Genehmigungen im Rahmen der illegalen Ausländerbeschäftigung

The study deals with the (missing) administrative permit, which is often subject of criminal offences, in its temporal context, and thus with the hardly examined interface between administrative-accessory and intertemporal criminal law. Its focus is on the question of how criminal liability is affected by changes made to laws or administrative decisions concerning the criterion "without (required) administrative permit" and which occur between the conduct of the offence and the criminal court decision. For this purpose, various cases are categorised and subjected to a legal evaluation. The area of illegal employment of foreigners, which is of practical importance for secondary criminal law, is used as an example for the questions arising in connection with the criterion of the administrative permit.
