The application of the new media ownership rules raise difficult questions related to the interpretation of the rules which have not yet been resolved by the practice of the newly established Concentration Examination Commission (Kommission zur Ermittlung der Konzentration im Medienbereich). The reason is that the media ownership rules provided in the Interstate Treaty on Broadcasting are not precise and not practicable. In addition to the media ownership rules general competition law applies to the media sector.
The purpose of this book is to analyse and to compare media ownership rules and general competition law on the basis of the practice of Media and Competition Authorities as well as Court rulings with respect to the goal to protect pluralism and competition in the media sector.
