As victims of international crimes, minorities are involuntary protagonists of international criminal law, but the protection they enjoy through the criminalisation of genocide, crimes against humanity and war crimes is limited. Embedded in human rights, public international law recognises rights of minorities, thereby – for various reasons – protecting their specific idproduct. In contrast, international criminal law complements this protection only to a certain degree by sanctioning massive human rights violations. In order to determine the extent and the different methods of this protection, this book compares general public international law and international criminal law. The examination of the scope of explicit consideration and the direct or indirect protection of the rights of minorities in offences of international law is particularly relevant.
