Against this background and after a thorough critical examination of the conventional concepts of the demarcation between the aforementioned issues, Pascal Winkler notes that there is an urgent need for legislative action in order that abusive forms of employment contracts can be curbed effectively. In this context, he does not only conduct a critical examination, but also submits concrete proposals for regulations with which to clarify the demarcation, identify means of social protection of contract employees and strengthen the participation rights of the works council.
