The change in meaning of on-site work contracts in business has long remained unnoticed. Once the provision of temporary workers has been regulated, such work contracts increasingly serve as an instrument of personnel recruitment, with the result that the boundaries between the use of work contracts and the hidden provision of temporary workers are further blurred or even deliberately crossed. Against this background and after a thorough critical examination of the conventional concepts of the demarcation between the aforementioned issues, Pascal Winkler notes that there is an urgent need for legislative action in order that abusive forms of employment contracts can be curbed effectively. In this context, he does not only conduct a critical examination, but also submits concrete proposals for regulations with which to clarify the demarcation, identify means of social protection of contract employees and strengthen the participation rights of the works council.
