Description
The system of competitive pricing through supply and demand does not provide an equitable solution for pricing on drugs which are market exclusive due to patent-protection. The AMNOG-regulation procedure has been regulating the reimbursementss for patented, and as such, market-exclusive, drugs since 2011. The AMNOG procedure determines pricing based on findings from the regulatory approval procedure and shapes the economics of individual prescriptions. However, personalized gene therapies, whose benefits is only scientifically provable within limits, yet are high in price, exemplify, that the AMNOG procedure is increasinly reaching its limits in these interface issues. This thesis analyzes these interface problems and ends with a regulatory proposal.
