Since 2010, the European legislator has set the legal framework for the legalisation of product placements in European movies in order to strengthen the competitiveness of European movie productions. However, this goal has not been reached. Product placements are still hardly used in German and European movie productions. The author believes that the current legal situation is the main reason for this. As part of her in-depth analysis of the relevant European and German legal rules and regulations, the author identifies a variety of obstacles which hinder the successful use of product placements in movie productions or make its usage at least less attractive. In addition, the author identifies other weaknesses of the relevant legal rules and regulations and develops solutions to improve the current legal framework.
