Modern society continuously challenges the traditionally repressive criminal law through increasingly complex matters. If the substantive law fails to overcome the challenges of the growing normative, cognitive and temporal shortcomings, the time has come for procedural law to take over: substantive deficits could be tackled by the use of flexible, especially discursive procedural elements, and social acceptance could be enhanced through participation of the directly affected persons.
