Modern society continuously challenges the traditionally repressive criminal law through increasingly complex matters. If the substantive law fails to overcome the challenges of the growing normative, cognitive and temporal shortcomings, the time has come for procedural law to take over: substantive deficits could be tackled by the use of flexible, especially discursive procedural elements, and social acceptance could be enhanced through participation of the directly affected persons. This book demonstrates in a comprehensive matter that such procedural criminal law is compatible with the applicable law in force, and that it carries the potential of more effectively protecting legal assets, increasing legal certainty and disburdening law enforcement and judicial authorities from the difficult substantive identification of criminal behaviour.
