Recht ohne Zufall?

Should we systematically use new technologies like AI to make it impossible to act unlawfully? Should we systematically use AI and other new technologies to make unlawful action impossible? Or is there a “right to break the law” that prohibits precisely that? This book examines the types of digital mechanisms that are already being used to enforce the law or could soon be used to do so. These technologies open up a world in which the many practical challenges posed by the increasingly complex laws of our time could be overcome. In a democratic society that is beginning to doubt its problem-solving abilities, this promise of optimization seems tempting. However, as will be shown, there are good reasons, especially in a democracy, to preserve at least some freedoms for deviant behavior, thus protecting the contingency of the legal system as such.
