This book by Kerstin Steidte-Megerlin details the legal services provided by factoring institutes licenced in Germany according to the Legal Services Act (RDG) and examines their collection of receivables and ‘mixed forms’ of factoring subject to a licence requirement as stipulated by § 10 (1) no. 1 of the RDG (debt collection permit). To this end, Steidte-Megerlin first of all undertakes a detailed classification of the broad spectrum of activities of factoring institutes, such as legal advice on sales and investment issues, solvency monitoring of debtors and extrajudicial and judicial collection of receivables, and defines and compiles mixed forms of factoring. The book deals extensively with the limits and legal consequences stipulated by the legislators in the case of corresponding violations, in particular of an activity without registration. It focuses on examining the effectiveness of the assignment of receivables, which underlies factoring.
