The existence of the basic right to a humane minimum subsistence level was explicitly upheld by the German Federal Constitutional Court. Since the Courts’ ruling from February 9, 2010, the debate on the constitutionality of sanctions within the German Social Code (Book II – Basic Income for Jobseekers) has gained momentum.
