Details
The development of state formation in Europe has proceeded under special conditions as jurisprudence was influenced sustainably by the heritage of the ancient world with Roman and ecclesiastical law. It is impossible to adequately describe state and politics since the late Middle Ages without considering omnipresent legal arguments. They reflect the beliefs of the past, amongst which the law was of extraordinary importance.
The articles of this book continue two volumes on this subject, published in 2009. The new articles address, on the one hand, specific problems of law, on the other, they concentrate on broader fields of research. The following subject areas are explored: 1. Medieval formation of law and rule; 2. Court, atonement and punishment in the late Middle Ages and early modern times; 3. State formation and jurisprudence in eastern Europe; 4. Jurisprudence and state formation between humanism and enlightenment; 5. Trans-state processes.
