Tokenisierung von Kunstwerken durch Non-fungible Token

For the first time, this work deals in detail with the exploitation rights of tokenization and the digital distribution of works of art with the aid of so-called NFTs. The work deals with the applicability of exploitation rights to the cases discussed here. In this context, a distinction is made between the individual steps of tokenization. In addition, important follow-up questions, such as the applicability of the principle of exhaustion, are examined in more detail. The special features of trading in NFTs require a review of the conventional system of exploitation rights. Finally, based on the findings, proposals for an adaptation of the Copyright Act are presented.
