Details
The UNIDROIT Principles of International Commercial Contracts provide an excellent and practice proven tool for cross-border contracts:
  • They constitute a neutral and pragmatic business-oriented contractual regime for cross-border contracts
  • They contain multiple solutions to typical contractual questions regarding the life of a contract, often by way of a compromise between civil and common law
  • They have been referenced in hundreds of decisions of arbitral tribunals or national state courts
  • They have been endorsed inter alia by the United Nations Commission on International Trade Law (last in 2021) and the Union Internationale des Avocats (2020) bringing together through its bar association and individual members approximately two million lawyers in more than 110 countries Thirty years after their first publication, it is arguably malpractice to ignore them. In this fully revised and enlarged 2nd edition, the commentary continues to analyse the UNIDROIT Principles article by article from a practical perspective, while always discussing alternative courses of action, where they apply. The commentary includes proposals for choice of the UNIDROIT Principles’ clauses and practical guidance for their use as template, or to supplement the CISG or national law. In addition to arbitral and state court decisions and recent literature, the 2nd edition includes an in-depth analysis of extensive legislative material. The author is a German practitioner with international training and familiarity with both common and civil law. He has been admitted to the New York Bar and also teaches at the University of Hamburg as a Professor of Law. The author is using the UNIDROIT Principles for more than 20 years in his commercial and arbitration practice, in recent years on a daily basis in multiple industries. As he shares his experience under the UNIDROIT Principles, the commentary can also be used as a practical guide and checklist of issues to consider in international contracting.

»Like the UNIDROIT Principles themselves, the organisation and presentation of the commentaries readily facilitate easy access to the particular article of interest, making the work an indispensable reference for today´s busy arbitration practitioners.«
Prof. Janet Walker, The International Construction Law Review 2019, 586

Mauro Loosli, AJP/PJA 12/2019, 1383

»In all, the work is well designed to serve as a handy desk reference for practioners interested in learning more about the Principles, and seeking to apply the Principles in the context of international trade transactions. Or in considering how the Principles, if adopted, might impact an international commercial arbitration.«
    Ian Davidson, ALJ 2019, 967

»Brödermann, as a widely acknowledged arbitractor and contract lawyer, provides the reader with a smart, well-structured and practice-oriented guide that fills the text of the Principles with life. He has an excellent overview of the complete set of the UNIDROIT Principles and manoeuvres the reader elegantly through ist, by cross-referencing, systematizing, thematic regrouping. The numerous illustrations and practical hints - also drawn from own arbitration cases - contribute to making this commentary an invaluable guide for any international contract lawyer.«
Christiana Fountoulakis, European Journal of Law Reform 4/2019, 629

»Prof. Eckart Brödermann has single-handedly commented one of the most important codifications of the early twenty-first century, and his work will endure for decades, as it will be the gateway to access the innovations and immensely practical
solutions of the UNIDROIT Principles. Practitioners and law students all over the world should be thankful to him for this serious and reliable Commentary.«
François Dessemontet, Professor Emeritus, Journal of intern. Arbitration 4/2019, 537

»If the alternative global-minded choice of UNIDROIT Principles is made, ›UNIDROIT Principles of International Commercial Contracts‹ by Eckart Brödermann is undoubtedly the book to use.«
Dr. Antje Baumann, SchiedsVZ 3/2019, 147-148

Prof. Dr. Burghard Piltz, IHR 3/2019, 130

    Prof. Dr. Dr. h. c. Rolf A. Schütze, IWRZ 2/2019, 95

»In summary, the PICC are an important instrument for cross-border B2B contracts. Brödermann´s article-by-article commentary provides a useful tool in utilising the PICC when drafting cross-border contracts, advising businesses and resolving disputes (once there is a dispute governed by the PICC).«
Prof. Petra Butler, VUWLR 2018, 412

»hervorragend gelungen...

»In combination with the author´s unique style, clear and concise language and highly practical perspective, the Commentary will be a standard reference tool for everybody who works with the UPICC, in academic circles as well as in international contract and arbitration practice.«
Prof. Dr. Klaus Peter Berger, Arbitration International 2018, 3
