Verbrauchergewährleistungsrecht und allgemeine Kodifikation

The dissertation examines the development of the implementation of EU warranty law in Germany and Austria from a comparative law perspective with the aim of developing perspectives for an appropriate implementation from a systematic point of view. To this end, both the dogmatic foundations of private consumer law and the challenges and possibilities of legal harmonization through EU law are examined. The main focus of the work is the comparison of the systematic implementation of the Consumer Sales Directive with the implementation of the Sale of Goods Directive. On this basis, criteria for a systematically suitable transposition of EU warranty law into national law are established.
