The work examines the enforcement of non-private consumer protection law by means of tort law. The focus in Germany lies on sec. 3a UWG as well as sec. 823 para. 2 BGB and in England on the common law tort of breach of statutory duty. In addition, other laws are also examined, which transfer the rules or at least the legal assessments from one field of law to another and integrate them into the particular system. In this context, the author examines, in a functionally comparative way, the question of which qualitative requirements the tort law imposes on the enforcement of public-law regulations and the reasons behind such allowance or restriction of enforcement. This analysis is enriched with particular reference to product safety regulations. Using the acquired insights, the author develops the dogmatic term of “Transformationsnorm” and assigns it to the dogmatics and function of the tort law.
