A new Multilateral Investment Court (MIC) is to be the answer to criticism, particularly voiced in recent years in context with CETA and TTIP, of international investment protection law in general and of ad hoc arbitration between investors and states in particular. Key points of such a permanent court are its strictly constitutional design, which includes the highest requirements for the judicial appointment procedure as well as personal integrity, independence and qualification of the judges. A possible cost reduction for all parties concerned, as well as aspects of transparency, the uniformity of jurisprudence and an effective enforceability of the decisions are also considered. The present study on MIC feasibility is to contribute to a broader discussion of design possibilities of such a new international specialised court for issues of investment protection.
