State responsibility is a consequence of the discussion about state tasks, especially in the context of privatizations and changes of purpose. Using railroading as reference field, Thomas Schuster shows that, behind the standardized responsibility for indemnity of Article 87e, Paragraph 4 of the Basic Law, there is a larger, more comprehensive system of state responsibility that is put into operation when tasks previously carried out in a monopolistic manner by the state are privatized. The responsibility arising in this way is the guideline for the design of simple law and a specification for jurisdiction and administration.
