Der Band beschäftigt sich mit Rechtswegfragen im Staatshaftungsrecht. Er untersucht, welche verfassungsrechtlichen Anforderungen an Rechtswegzuweisungen gestellt werden können. Dabei beantwortet er Rechtsfragen des Zusammenwirkens von Art. 14 Abs. 3 GG, Art. 34 S. 3 GG und § 40 Abs. 2 S. 1 VwGO einerseits und deren dogmatische Einordnung, auch anhand der historischen Ursprünge, andererseits. Dafür wird eine Unterscheidung zwischen primärem und sekundärem Rechtsschutz getroffen und auf die Konsequenzen der aktuell bestehenden „Rechtswegzersplitterung“ eingegangen. Unter Zugrundelegung der Maßstäbe zeigt der Band auf, dass durch Rechtswegzuweisungen auch ein optionales Adhäsionsverfahren im Verwaltungsprozess ermöglicht werden kann.
englischThis volume deals with questions of legal recourse in state liability law. It examines the constitutional requirements that can be placed on the allocation of legal remedies. In doing so, it answers legal ques-tions about the interaction of Article 14 (3) of the Basic Law, Article 34 p. 3 of the Basic Law and Section 40 (2) p. 1 of the VwGO on the one hand and their dogmatic classification, also with reference to their historical origins, on the other. For this purpose, a distinction is made between primary and secondary legal protection and the consequences of the currently existing “fragmentation of legal recourse” are discussed. Based on those standards, the study shows that an optional adhesion procedure in administrative proceedings can also be made possible through the allocation of legal remedies.
