Unter Annäherung an dessen inhaltliche Form und besonderer Beachtung der ratio legis von § 24 StGB werden Tat- und Fehlschlagsbegriff modifiziert und die Relevanz des Täterplans trotz grundsätzlicher Anerkennung der Theorie vom Rücktrittshorizont hinterfragt.
Damit wird einem verselbstständigten Anwendungsbereich des Fehlschlags Einhalt geboten und der Rechtsfigur inhaltlich Grenzen gesetzt.
