Gesellschaft versus Recht
Die Schriftenreihe stellt das Spannungsverhältnis von Gesellschaft, Recht und Ökonomie in den Mittelpunkt. Die Logik der Monopolisierung und Konzentration einer globalisierenden Ökonomie überlagert zunehmend den traditionellen Rechtscode: Aus der der Perspektive der Ökonomie erscheint das Recht tendenziell als Störfaktor. Während der traditionelle Rechtscode im Dualismus von Recht und Unrecht seinen Ausdruck fand, ist der Code der Ökonomie vom Dualismus von Kosten und Nutzen gekennzeichnet. Globalisierte und unilaterale Transformationen bewirken ökonomische, politische, soziale und kulturelle Zerfallsprozesse. Unsicherheit und wachsendes Sicherheitsstreben sind die Folgen. Ungezügelter neoliberaler Markt-Fundamentalismus weitet sich aus. Neben dieser Verselbständigung von Ökonomie ‚jenseits von Recht‘ findet zugleich eine transnationale Verlinkung von Staat und Ökonomie unter Ausschluss des Gemeinwohls statt. Folge ist manifester Souveränitätsverlust der Bürgerinnen und Bürger. In dieser Reihe werden diese Zerfallsprozesse dokumentiert und analysiert.
The series focuses on the tense relationship between society, law and economy. The logic of monopolisation and concentration of a globalising economy is increasingly overriding the traditional legal code: From the perspective of the economy, law tends to appear as a disruptive factor. While the traditional legal code found expression in the dualism of right and wrong, the code of the economy is characterised by the dualism of costs and benefits. Globalised and unilateral transformations cause economic, political, social and cultural disintegration processes. Insecurity and a growing striving for security are the consequences. Unbridled neoliberal market fundamentalism is spreading. Alongside this independence of the economy 'beyond the law', a transnational linkage of state and economy is taking place to the exclusion of the common good. The consequence is a manifest loss of sovereignty on the part of citizens. This series documents and analyses these processes of disintegration
